News from The Hill: Supreme Court seems open to killing Defense of Marriage Act By Sam Baker The Supreme Court indicated Wednesday that it is open to striking down the federal law defining marriage as a union between a man and a woman. The court heard arguments Wednesday in a challenge to the Defense of Marriage Act (DOMA), the 1996 law that prohibits same-sex couples from collecting certain federal benefits, even if they live in a state that recognizes same-sex marriage. Justice Anthony Kennedy, the court's swing vote, seemed to agree with the argument that DOMA interferes with states' traditional right to define marriage. "The question is whether the federal government, under our federalism scheme, has the authority to regulate marriage," Kennedy said. The court's liberal justices also appeared hostile to DOMA.
